Can a Portuguese company hire a Brazilian worker residing in Brazil?
Yes, through an employment contract that may provide for remote work or relocation to Portugal. Where there is relocation, the employee requires an appropriate residence permit (often a D1, D3 or D8 visa), and there are social security, tax and employment obligations that must be coordinated in advance.
What is international secondment?
It is the regime applicable to an employee who, while maintaining the employment relationship with the original employer, performs their activity in another country for a fixed period. The regime has specific implications in terms of social security, namely under the Ibero-American Multilateral Social Security Agreement, and requires specific documentation.
Can the probationary period in Portugal be freely set?
No. The probationary period has legal limits depending on the employee category and the type of contract, and its duration must be expressly provided for in the written contract. The limits vary significantly between categories, particularly for senior executives.
