These Terms of Use govern access to and use of the website www.piauhylino.pt (hereinafter the Site), owned by Piauhylino & Associados, Sociedade de Advogados (hereinafter the Firm). Use of the Site implies full acceptance of these Terms. Users who do not agree with any of the provisions set forth herein must refrain from using the Site.

  1. Identification of the Site Owner

The Site is owned and operated by Piauhylino & Associados, Sociedade de Advogados, with registered office at Avenida Aida, Estoril Garden, Block 1, Office 112, 2765-187 Estoril, Portugal, registered with the Portuguese Bar Association under number [to be confirmed by the partners], holder of tax identification number [to be confirmed by the partners], contactable at info@piauhylino.pt.

  1. Nature and Purpose of the Site

The Site is purely informational and institutional in nature. It is intended to present the Firm, its partners and the practice areas in which it operates, as well as to provide contact channels with the Firm.

The information provided on the Site does not constitute legal advice, technical opinion, professional guidance or recommendation for action. The content of the Site does not replace direct consultation with a lawyer for the assessment of specific situations, where each case must be evaluated in light of its particular facts and legal circumstances.

  1. Absence of Attorney-Client Relationship

Mere access to the Site, consultation of its contents or sending a message through the channels provided therein does not establish any professional relationship between the user and the Firm, nor does it give rise to the formation of a legal mandate. The formation of a mandate depends on express acceptance by the Firm, preceded by conflict of interest assessment and formalization of applicable terms.

Consequently, users are advised not to send confidential or sensitive information through the channels provided on the Site prior to the formal establishment of a professional relationship.

  1. Professional Compliance

The Site complies with the regime applicable to legal advertising in Portugal, namely the Portuguese Bar Association Statute (Law No. 145/2015, of September 9), the Advertising Regulations of the Portuguese Bar Association and other professional standards. With regard to communications directed to the Brazilian public, the Site observes the Code of Ethics and Discipline of the Brazilian Bar Association and Provision No. 205/2021 of the Federal Council of the OAB.

  1. Intellectual Property

All contents of the Site, including its structure, organization, texts, images, photographs, illustrations, trademarks, logos, videos, audio, downloadable files and any other elements, are the property of the Firm or of third parties who have granted the Firm the necessary rights of use, and are protected by legislation on copyright, related rights and industrial property.

Users are prohibited from reproducing, distributing, publicly communicating, transforming, altering, displaying, exhibiting, transmitting or otherwise exploiting, in whole or in part, the contents of the Site for commercial purposes or to the detriment of the interests of the rights holder, without prior express written authorization from the Firm.

Personal and non-commercial use, namely for information or study purposes, is permitted provided that the integrity of the contents is preserved and the source is acknowledged.

  1. Hyperlinks to Third-Party Sites

The Site may contain hyperlinks to websites owned or operated by third parties, provided for user convenience. The Firm does not control, endorse, guarantee or assume responsibility for the contents, privacy policies or practices of such third-party sites. Access to such sites is at the user’s sole risk.

The creation of hyperlinks to the Site by third parties requires prior written authorization from the Firm and must, in any case, comply with applicable legal standards and not associate the Site with content harmful to the image, reputation or rights of the Firm, its partners or staff.

  1. Limitation of Liability

The Firm makes every effort to ensure the accuracy, currency and completeness of the information provided on the Site. Notwithstanding, the information is provided as is, without warranty, express or implied, as to its suitability for any particular purpose or its application to specific cases.

Without prejudice to the mandatory regime applicable to liability for the practice of law, and to the extent legally permitted, the Firm is not liable for direct or indirect, material or immaterial damages resulting from use of the Site, namely those arising from:

(i) Reliance on information provided for decision-making without prior formal legal consultation;

(ii) Temporary unavailability of the Site, slow response or operational errors;

(iii) Interruptions, technical failures or cyberattacks affecting the Site;

(iv) Contents of third-party sites accessed through hyperlinks provided on the Site.

  1. Site Availability

The Firm does not guarantee uninterrupted operation of the Site, reserving the right to suspend, modify, restrict or discontinue, in whole or in part, its operation, namely for maintenance, technical updates or security reasons.

  1. User Obligations

Users undertake to make lawful use of the Site, refraining in particular from:

(i) Engaging in any act likely to affect the operation, integrity or security of the Site, or to compromise the rights of the Firm or third parties;

(ii) Accessing restricted areas of the Site without authorization or using third-party credentials;

(iii) Sending, through the channels provided, unlawful, offensive, defamatory, threatening, fraudulent communications or communications constituting harassment.

  1. Personal Data Protection

The processing of personal data carried out in connection with use of the Site is governed by the Privacy Policy, an integral part of these Terms, available via a dedicated link in the footer of the Site.

  1. Amendments to the Terms of Use

The Firm reserves the right to update these Terms at any time, with the version in force being that published on the Site. Continued use after publication of an amended version implies acceptance of the new terms.

  1. Applicable Law and Jurisdiction

These Terms are governed by Portuguese law. For the resolution of any dispute arising from use of the Site, the Judicial Court of the District of Lisboa Oeste has jurisdiction, with express waiver of any other, without prejudice to mandatory consumer law under Law No. 144/2015, and the right to resort to alternative consumer dispute resolution mechanisms as legally provided.
